“Sold in 30 Days. Or We List it For Free” – Terms & Conditions

1. Program Overview
The “Sold in 30 Days Guarantee” (“Program”) is a discretionary promotional offering by Colony Realty Inc. whereby the Brokerage agrees that, subject strictly to the terms herein, if a listed property does not sell within thirty (30) calendar days, the Brokerage may reduce or waive its portion of the commission.
This Program is not a guarantee of sale, but a conditional commission reduction incentive.
2. Mandatory Pricing Condition
Eligibility for the Program is strictly contingent upon the Seller:
- Listing the property at the price recommended in writing by the Brokerage, based on a data-driven market analysis; and
- Not altering, rejecting, or inflating the recommended list price.
If the Seller chooses to list above the recommended price at any time, the Program is immediately void.
3. Offer Threshold Condition (10% Rule)
The Program shall be deemed fulfilled, and no commission reduction shall apply, if:
- The Seller receives any bona fide written offer within ten percent (10%) of the list price, regardless of whether the Seller accepts or rejects such offer.
Failure of the Seller to accept such an offer does not trigger eligibility for a free listing or commission waiver.
4. Marketing & Cooperation Requirements
To qualify, the Seller must:
- Allow full implementation of the Brokerage’s marketing strategy, including but not limited to:
- MLS® listing
- Professional photography
- Online and social media marketing
- Open houses (if recommended)
- Maintain the property in show-ready condition at all times
- Provide reasonable access for showings
- Not interfere with or restrict marketing efforts
Any limitation imposed by the Seller voids the Program.
5. Commission Structure Requirement
The Program applies only where:
- A full cooperating commission is offered to buyer agents (as determined by the Brokerage);
- No reductions, caps, or limitations are imposed by the Seller on cooperating commission.
Failure to meet this requirement voids eligibility.
6. Excluded Property Types / Situations
The Program does not apply to:
- Unique, luxury, or specialty properties deemed atypical by the Brokerage
- Rural, agricultural, or commercial properties
- Properties with restricted access
- Distressed sales, foreclosures, or court-ordered sales
- Properties previously listed and expired within the last 90 days
7. Relisting / Reset Clause
If the property is withdrawn, terminated, or relisted:
- The 30-day period resets at the sole discretion of the Brokerage
- The Program may be revoked entirely
8. Commission Waiver Scope
If all conditions are met and the property does not sell within 30 days:
- The Brokerage may waive only its portion of the listing-side commission
- The Seller remains responsible for:
- Cooperating commission to the buyer’s brokerage
- Any applicable fees, expenses, or third-party costs
9. Broker Discretion
The Program is offered at the sole and absolute discretion of the Broker.
The Broker reserves the right to:
- Approve or deny participation
- Modify or terminate the Program at any time
- Determine eligibility on a case-by-case basis
- Refuse application where it may contravene RECA rules or the Real Estate Act (Alberta)
10. No Guarantee of Sale
This Program does not guarantee that the property will sell within 30 days.
It is a conditional commission incentive only, not a performance guarantee.
11. Compliance
This Program is intended to comply with the Real Estate Act (Alberta) and all applicable RECA regulations. Any non-compliant provision shall be severed without affecting the remaining Terms.
12. Acknowledgment
Participation in the Program requires execution of a written Listing Agreement and Schedule A, confirming full understanding and acceptance of these Terms & Conditions.
