Cashback Program – Terms & Conditions

1. Program Overview

The Colony Realty Inc. Cashback Program (“Program”) is a discretionary promotional incentive offered to eligible buyers who complete the purchase of real property in Alberta through Colony Realty Inc.

Under this Program, a portion of the commission received by the Brokerage may be rebated to the buyer in the form of a cashback payment, subject strictly to the terms outlined below.

2. Commission Structure Assumption

Any advertised cashback amounts, examples, or promotional materials are calculated based on the following assumed cooperating commission structure:

3.5% on the first $100,000 and 1.5% on the remaining balance of the purchase price.

Actual cashback amounts may be higher or lower depending on:

  • The actual commission offered and received;

  • Any reductions negotiated;

  • Referral fees or brokerage obligations;

  • Transaction-specific costs;

  • The sole and absolute discretion of the Broker.

The Brokerage does not guarantee any specific cashback amount unless confirmed in writing.


3. Eligibility Requirements

To qualify for the Program:

  1. The buyer must enter into a written Buyer Representation Agreement with Colony Realty Inc.

  2. The transaction must close successfully.

  3. The Brokerage must receive full cooperating commission (full cooperating commission is defined as 3.5% on the first $100,000 and 1.5% on the remaining balance of the purchase price) from the listing brokerage even if the listing brokerage is Colony Realty Inc itself.

  4. The buyer must not be in breach of any agreement with the Brokerage.

  5. The Client must sign a “Schedule A” with Colony Realty Inc., which outlines the applicable terms and conditions governing the cashback program. Execution of “Schedule A” constitutes the Client’s acknowledgment and acceptance of such terms and conditions and is a prerequisite to eligibility for, and disbursement of, the cashback amount.. 

Cashback is not available for:

  • Private transactions where commission is not received;

  • Transactions involving reduced or zero cooperating commission unless otherwise agreed in writing;

  • Deals involving referral fee obligations unless approved in writing by the Broker.


4. Payment of Cashback

  • Cashback will be paid only after the successful closing of the transaction and after commission funds have been received and cleared by the Brokerage.

  • Payment will be made by cheque, electronic transfer, or as otherwise determined by the Brokerage.

  • Cashback cannot be applied as a deposit, used to reduce purchase price, or credited on trust unless legally permitted and approved in writing.


5. Broker Discretion

The Cashback Program is offered at the sole and absolute discretion of the Broker.

The Broker reserves the right to:

  • Approve or deny participation in the Program;

  • Adjust cashback amounts on a transaction-by-transaction basis;

  • Modify or terminate the Program at any time without prior notice;

  • Refuse cashback where doing so would contravene RECA rules, the Real Estate Act (Alberta), or any applicable regulation.


6. No Guarantee of Savings

Cashback amounts are promotional incentives and do not constitute a guarantee of savings or financial benefit. Buyers are encouraged to seek independent financial and tax advice regarding any rebate received.


7. Compliance

This Program is intended to comply with the Real Estate Act (Alberta) and all applicable RECA rules and regulations. If any portion of these Terms & Conditions is found to be non-compliant, such portion shall be severed without affecting the remaining provisions.


8. Amendments

Colony Realty Inc. reserves the right to amend these Terms & Conditions at any time. The version in effect on the date of the Buyer Representation Agreement shall govern the transaction unless otherwise agreed in writing.
